Commission proposes Directive on the Protection of the EU’s Financial Interests

On July 11th, the Commission proposed a Directive on the fight against fraud to the Union’s financial interests by means of criminal law (COM 2012(363) final). The Union thereby takes the protection of its financial interests to a new (supranational) level. The proposed framework shall in the future replace the regime of the so called PIF Convention and its Protocols. The proposal is based on Art. 325 (4) TFEU and does not only the fight of fraudulent conduct but also extends to money laundering, misappropriation of funds, corruption and providing false information in a public procurement or grant procedure. For the first time, the proposed Directive introduces minimum penalties.

In its plenary session of May 21st, 2012, the European Parliament passed an „EU approach to criminal law“ and and called for observing general principles of criminal law by taking recourse to and expressly mentioning the European Criminal Policy Initiative.

ECPI Stockholm Meeting in March 2012

The members of the ECPI met in Stockholm in March 2012 for a kick-off meeting regarding the development of general principles for approximating the laws of criminal procedure. Based on their experiences with the first manifesto and the respective comments and suggestions the group received from scholars and legal practitioners, the group developed a general framework for assessing and formulating these principles, which are all part of the law of the European Union. This framework will ensure a comprehensive analysis of these principles and at the same time allow for applying them to concrete policy proposals.

EuCLR 2012 Issue 1 available

The latest issue of EuCLR is now available. In their contributions, the authors discuss a variety of topics, inter alia the principle of mutual recognition as a utilitarian solution, procedural safeguards in EU law, the European Arrest Warrent and its interpretation and developing tendencies of criminal law and criminal procedure in Austria.
